Abstract: El presente informe de tesis se centró como objetivo general el
determinar si resulta necesaria la inclusión de la participación del
abogado como figura agravada en el artículo 4 del decreto legislativo N°
1106 que regula la lucha eficaz contra el lavado de activos.
En la etapa de recopilación de información para la elaboración de los
capítulos del marco teórico se utilizó las fuentes de consulta como son
libros, revistas jurídicas y legislación nacional y comparada, empleando
en el acopio de los datos las técnicas del fichaje y análisis de
documentos y como instrumento se utilizaron las fichas propias de una
investigación cualitativa.
En cuanto a los resultados de la investigación desarrollados en los
capítulos del marco teórico se obtuvo que el lavado de activos es un
fenómeno social, nacional e internacional, mutable que comprende
aquellas actividades realizadas en las fases de colocación, intercalación
e integración dirigidas a ocultar la fuente del dinero que se han
obtenido a través de actividades ilegales; en las cuales destaca la
participación del abogado que no se le obliga en sentido estricto a
declarar ante la UIF, y que su participación es pasible de sanción en la
figura básica.
La conclusión principal del trabajo de investigación es que el profesional
de las ciencias jurídicas que en el ejercicio de su profesión realiza actos
que quebrantan el orden jurídico con pleno conocimiento en el terreno
del delito de lavado de activos no puede ser considerado en la formula
básica, se recomienda que su responsabilidad penal se debe ubicar en
la modalidad agravada contenido en el artículo 4 del decreto legislativo
N° 1106.
The present thesis report focused as a general objective to determine if it is necessary to include the participation of the lawyer as an aggravated figure in article 4 of Legislative Decree No. 1106 that regulates the effective fight against money laundering. In the information gathering stage for the elaboration of the chapters of the theoretical framework, the sources of consultation were used, such as books, juridical journals and national and comparative legislation, using in the collection of the data the techniques of the signing and analysis of documents and As an instrument, the qualitative research files were used. Regarding the results of the research developed in the chapters of the theoretical framework, it was found that money laundering is a social, international, mutable phenomenon that includes those activities carried out in the placement, intercalation and integration phases aimed at hiding the source of the money that has been obtained through illegal activities; which highlights the participation of the lawyer who is not obligated in a strict sense to declare before the UIF, and that his participation is subject to sanction in the basic figure. The main conclusion of the research work is that the professional of the legal sciences who in the exercise of their profession performs acts that violate the legal order with full knowledge in the field of the crime of money laundering cannot be considered in the basic formula, it is recommended that their criminal liability be placed in the aggravated modality contained in article 4 of Legislative Decree No. 1106.
