Abstract: La presente investigación titulada “El interés superior del niño en la Constitución
Política del Perú de 1993”, establece la importancia de enunciar en nuestra Carta
fundamental esta institución jurídica como un principio y un derecho. La
problemática planteada fue: ¿por qué es importante que se enuncie el interés
superior del niño en la Constitución Política del Perú de 1993?; como hipótesis se
infirió, que al enunciarse en nuestra Constitución Política del Perú el interés
superior del niño como un principio y un derecho, se estaría justificando la
relevancia que tiene ante el Estado, exhortando la creación de políticas y
normativas adecuadas de protección a favor de los niños, niñas y adolescentes.
Para su análisis usamos los métodos lógico y jurídico: deductivo e inductivo,
dogmático, hermenéutico y comparativo. Se empleó la técnica del análisis
bibliográfico y documental; los instrumentos de investigación usados fueron:
fichas bibliográficas y el análisis de documentos. Se concluyó que el Código de
los Niños y Adolescentes contiene a este principio; y que los Códigos: Civil,
Penal, Procesal Civil y Penal son normas supletorias en cuanto se refieran a los
menores, pero trascendería su importancia si se encontrara enunciado en nuestra
Carta Magna.
The present investigation is titled “The superior interest of the child in the Political Constitution of Peru of 1993“, it establishes the importance of stating in our Fundamental Charter this legal institution as a principle and a right. The problem statement is as follows : is it important that the best interests of the child be stated in the 1993 Political Constitution of Peru ? The inferred hypothesis is that, if the best interests of the child are enunciated in our Political Constitution of Peru as a principle and a right, its importance would be justified, and it would allow the State to promote adequate protection policies and regulations in favor of children and adolescents. Teenagers. For its analysis we use the logical and legal methods : deductive and inductive, dogmatic, hermeneutical and comparative. The technique of bibliographic and documentary analysis was used ; The research instruments used were : bibliographic records and the analysis of documents. It was concluded that the Code of Children and Adolescents contains this principle; and that the Codes: Civil, Penal, Civil Procedure and Penal are supplementary norms as far as they refer to minors, but their importance would transcend if they were enunciated in our Magna Carta.
