Abstract: La presente investigación se encuentra relacionada a la problemática advertida por
la investigadora en su ámbito profesional vinculado a la inexistencia de una
regulación normativa que se encargue proteger legalmente la conformación de
uniones entre personas del mismo sexo, quienes comparten una vida en común y
lazos de afectivos, constituyendo una familia como tal, la cual cumple con los
requisitos esenciales y por ende, es necesario su establecimiento en nuestro marco
jurídico como una institución jurídica. En ese sentido, se analiza nuestra
problemática a la luz de la doctrina y el derecho comparado, a fin de determinar los
fundamentos jurídicos que deberán tenerse en cuenta para el reconocimiento de
dichas uniones, así como la elaboración de un proyecto legislativo que coadyuvará
a que se garanticen los derechos de la comunidad LGBTI+, contenidos en nuestra
Constitución Política y tratados internacionales. Asimismo, se debe entender que
merece protección legal una nueva clase de familia que surge a partir de una
convivencia afectiva entre dos personas del mismo sexo, excluyendo la influencia
de la heteronormatividad de nuestra legislación.
Cabe agregar que el trabajo de investigación es de tipo aplicada con enfoque
cualitativa, por lo que, se recabó información de nuestra unidad de análisis
conformada por especialistas en Derecho de Familia y Derecho Constitucional e
integrantes de la Comunidad LGBTI+, la misma que se analizó para la obtención de
resultados relacionados a la protección legal de la unión homoafectiva y se garantice
el bienestar de las personas homosexuales, sin ser excluidos por su orientación
sexual y/o identidad de género.
The present investigation is related to the problem noticed by the researcher in her professional field linked to the inexistence of a normative regulation that is in charge of legally protecting the conformation of unions between persons of the same sex, who share a common life and bonds of affection, constituting a family as such, which complies with the essential requirements and therefore, it is necessary its establishment in our legal framework as a legal institution. In this sense, our problem is analyzed in the light of doctrine and comparative law, in order to determine the legal foundations that must be taken into account for the recognition of such unions, as well as the elaboration of a legislative project that will contribute to guarantee the rights of the LGBTI+ community, contained in our Political Constitution and international treaties. Likewise, it should be understood that a new kind of family that arises from an affective cohabitation between two people of the same sex, excluding the influence of heteronormativity of our legislation, deserves legal protection. It should be added that the research work is applied with a qualitative approach, therefore, information was collected from our unit of analysis formed by specialists in Family Law and Constitutional Law and members of the LGBTI+ Community, which was analyzed to obtain results related to the legal protection of homoaffective union and to guarantee the welfare of homosexual persons, without being excluded because of their sexual orientation and/or gender identity.
