La función dictaminadora del tribunal constitucional como mecanismo de control previo de las reformas constitucionales en el perú

Abstract

La presente tesis se titula “La función dictaminadora del Tribunal Constitucional como mecanismo de control previo de las reformas constitucionales en el Perú” y proporcionará respuesta a la siguiente interrogante: ¿De qué manera la función dictaminadora del Tribunal Constitucional influye en el control de las reformas constitucionales en el Perú? Para ello, se empleó el tipo de investigación Básica, utilizando los métodos deductivo, inductivo, dogmático, comparativo-analógico e histórico; así mismo, se recurrió al fichaje y análisis de contenido. A través de esta tesis, se llegó a la conclusión de que el Tribunal Constitucional debe actuar como un órgano dictaminador, cuando existan vulneraciones constitucionales a través de las reformas a la Constitución.

This thesis is entitled ““The Constitutional Court's ruling function as a mechanism of prior control of constitutional reforms in Peru““ and will provide an answer to the following question: How does the ruling function of the Constitutional Court influence the control of constitutional reforms in Peru? For this, the Basic research type was used, using the deductive, inductive, dogmatic, comparative-analogical and historical methods; likewise, it was resorted to the signing and analysis of content. Through this thesis, it was concluded that the Constitutional Court should act as an adjudicating organ, when there are constitutional violations through reforms to the Constitution.
