The purpose of this thesis report was to determine how the prohibition of sentimental abortion due to sexual violation prescribed in the penal code is expressed in the constitutional rights that are recognized for women. In the data collection stage for the elaboration of the chapters of the theoretical framework, the sources of consultation were used, such as books, legal journals, national and comparative legislation, jurisprudence, using the information and registration forms as an instrument for gathering information. Regarding the results of the research developed in the chapters of the theoretical framework, it was obtained that the penalty of sentimental abortion due to sexual violation makes it unfeasible for a person to be sanctioned for this crime because it would immediately prescribe in the legal process that constitutional rights Violated are human dignity, the free development of his personality, the right to reproductive health, among others, and that diffuse control is applied in Colombia and Argentina, while his decriminalization is located in countries such as Spain, Argentina, Chile, Mexico, Bolivia and the Protocol to the African Charter on the Human Rights of Peoples in the Human Rights of Women in Africa. The main conclusion of the research work is that, the prohibition of sentimental abortion for sexual violation is unconstitutionally expressed by violating the constitutional rights that are recognized for women, as human dignity (article 1), the free development of personality (Article 2, subsection 1) and reproductive health (Article 7), therefore the exercise of diffuse control and subsequent decriminalization for indications and terms of sentimental abortion for sexual violation is recommended
