The present investigation has been entitled ““The right of a minor to keep his last name, even if said paternity has been challenged and the constitutional right to identity““; Therefore, through this letter, based on the jurisprudential analysis, we have sought to establish some legal bases, so that in particular and concrete cases, our courts can evaluate whether it is pertinent and in accordance with some rights of constitutional recognition, that the challenge of paternity, inflexibly; I ended up eliminating the last name of that boy or girl. That is why in this investigation, the following interesting conclusion has been reached: ““The legal grounds exist to affirm that a minor retains his paternal surname, even if said paternity has been challenged, they are the right to identity, especially since the optics of dynamic identity; Another of the foundations is the right to a name, since this not only defines the external characteristics of a person, but also has a function of identification and individualization of every human being; another foundation is the best interest of said child, since this rule, principle and right always strives for adequate and effective protection of that child or adolescent; finally, this measure is more in line with the conventional law that turns out to be more protective with the boy, girl or adolescent
