Abstract: El objetivo de esta tesis es conocer cómo influye la vulneración al derecho de
defensa del requerido durante la etapa de indagación patrimonial conforme a la nueva
legislación sobre Extinción de Dominio y su reglamento, normas que han adoptado el
modelo colombiano, excepto la etapa de “fijación provisional de la pretensión”. Sin
embargo, este trabajo de investigación se realizó en un enfoque cualitativo, que por su
orientación o finalidad, es básica o teórica, y por la técnica de contrastación, es una
investigación descriptiva y correlacional; y para ello, se ha recopilado la información
necesaria y relevante como fuentes dogmáticas, legales y jurisprudenciales, así como
también de las opiniones extraídas en las entrevistas a abogados, jueces y fiscales
capacitados en la materia estudiada, para lo cual se empleó una guía de entrevista, y se
analizó la jurisprudencia nacional y extranjera (colombiana); obteniendo como
conclusión más importante, la necesidad de una modificación legislativa para garantizar
el derecho de contradicción y a probar, que podrá ejercer el requerido durante la etapa de
indagación patrimonial, ello como una expresión de garantía al derecho de defensa que le
asiste a toda parte sometida a un proceso judicial.
The objective of this thesis is to know how the violation of the right of defense of the required one influences during the patrimonial investigation stage in accordance with the new Legislation on Extinction of Domain and its regulations, norms that have adopted the Colombian model, except for the ““fixation provisional of the claim” stage. However, this research work was carried out in a qualitative approach, which, due to its orientation or purpose, is basic or theoretical, and due to the contrast technique, it is a descriptive and correlational investigation; and for this, the necessary and relevant information has been compiled as dogmatic, legal and jurisprudential sources, as well as the opinions extracted in interviews with lawyers, judges and prosecutors trained in the subject matter, for which a guide of interview, and the national and foreign jurisprudence (Colombian) was analyzed; obtaining as a most important conclusion, the need for a legislative amendment to guarantee the right of contradiction and the right to prove, which may be exercised by the person required during the stage of property investigation, this as an expression of guarantee to the right of defense that assists him any party subjected to a judicial process.
