This thesis report establishes as a general objective, to determine how the incorporation of a labor promotion law in the hiring of people over 60 years of age would affect the protection of the right to work of the elderly in Peru, 2022. For this reason, in the information gathering stage, sources of consultation were used, such as books, legal magazines, legal web portals, relevant and binding jurisprudence, in addition to national and international legislation. Regarding the development of the theoretical framework, the thematic dispersion was divided into four chapters. The first chapter refers to the Human Rights of the Elderly and its legal regulation in Peru, where the social policies that the Peruvian State has in favor of the population are analyzed, noting the absence of regulations in the labor field of a special nature. in favor of older adults regarding the lack of job opportunities in the labor market. Likewise, the second chapter on the protection of the Right to Work, where the recognition and legal protection of the aforementioned right in national legislation is observed, however, its violation by the corresponding authorities is questioned. Regarding the third chapter, it deals with the incorporation of a Labor Promotion Law in the hiring of older adults in Peru, referring to the need to establish a specific regulation that promotes the hiring of the older adult population, taking as a reference the mandatory compliance with the employment quota of the General Law for Persons with Disabilities Law No. 29973. Finally, the fourth chapter deals with the regulation of the right to work of the elderly in comparative law, where the regulatory advances of other countries are analyzed, as well as the comprehensive inclusion of the aforementioned sector of the population. The fundamental conclusion of the research work refers to the fact that, in the face of the latent and current problem, there is a need to create a special law with reasonable adjustments and the relevant conditions for the benefit of the older adult population, which includes older people 60 years and older, the same that, its compliance must be mandatory in a certain percentage where the business sector will have to include the hiring of said sector, allowing respect for their human rights without any discrimination, referring to their access and participation in the workplace.
