Abstract: El presente trabajo tiene como fin dar con la correcta conceptualización del contrato
de trabajo a tiempo parcial, a través de la exposición de una definición legal que se
adecue a los estándares supranacionales del derecho laboral, dado que existe un
gran número de trabajadores contratados bajo este régimen laboral, los cuales no se
encuentran amparados dentro de la esfera de protección que el derecho laboral
peruano sí brinda al resto de trabajadores. Para ello, se han utilizado los métodos
analítico, sociológico-funcional e inductivo, en orden de cumplir con los objetivos de
la investigación: explicar la importancia de la protección del trabajador, establecer las
bases fundamentales de la contratación a tiempo parcial; y, del análisis concreto del
paradigma actual, justificar las razones para una definición adecuada y garantista.
Así, se tiene que es necesaria la implementación de una nueva definición, la cual
cubra el vacío que el laconismo legal ha creado con la única mención (en una norma
de rango legal) de este tipo de contratación en el artículo cuarto del Texto Único
Ordenado de la Ley de Productividad y Competitividad Laboral. Esta definición se
analiza desde los tres elementos constitutivos del contrato a tiempo parcial: jornada
reducida, modulo y periodo, y reducción remunerativa. Para que así sea exacta y no
genere nuevos errores interpretativos. Todo ello, a la luz de la normativa
supranacional establecida por el convenio 175 de la Organización Internacional de
Trabajo, la cual no se limita a una jornada reducida inferior a las cuatro horas diarias
como sucede en nuestra legislación; y por lo tanto, abre un mayor campo de
protección al trabajador.
The purpose of this work is to find the correct conceptualization of the part-time job contract, through the presentation of a legal definition that conforms to the supranational standards of labour law, given that there is a large number of workers hired under this labor regime, which are not covered within the sphere of protection that Peruvian labour law does provide to other workers. For this, the analytical, sociological-functional and inductive methods have been used, in order to meet the objectives of the investigation: to explain the importance of worker protection, to establish the fundamental bases of part-time hiring; and, of the concrete analysis of the current paradigm, to justify the reasons for an adequate and guarantee definition. Thus, it is necessary to implement a new definition, which covers the void that legal laconism has created with the sole mention (in a rule of legal rank) of this type of contracting in the fourth article of the Single Ordered Text of the Labor Productivity and Competitiveness Law. This definition is analyzed from the three constituent elements of the part-time contract: reduced working hours, module and period, and remunerative reduction. So that it is accurate and does not generate new interpretative errors. All of this, in the light of the supranational regulations established by International Labour Organization Convention 175, which is not limited to a reduced working day of less than four hours a day as in our legislation; and therefore, it opens a greater field of protection to the worker.
