Abstract: Este trabajo de investigación denominado “El arbitraje potestativo como mecanismo
ineficaz en la negociación colectiva” surge a raíz de la preocupación al imponerse el
arbitraje de manera unilateral por el trabajador o el empleador, dentro del vínculo laboral.
Lo que les correspondía a ambos, ahora puede ser decisión de una de las partes,
desvirtuando así el concepto primigenio de la negociación colectiva que consiste en llegar
a acuerdos a través del diálogo con el propósito de solucionar una controversia. De esta
manera, el arbitraje potestativo atenta contra la seguridad jurídica perjudicando tanto a
trabajadores como empleadores; resta, protagonismo a las organizaciones sindicales,
quienes deben representar a sus afiliados en sus negociaciones colectivas. Esta
investigación está constituida por IV apartados, divididos de la siguiente manera: el
capítulo I, titulado El problema, el cual abarca el planteamiento del problema,
formulación del problema, hipótesis, objetivos, justificación y antecedentes de la
indagación; el capítulo II, titulado Marco teórico, se subdivide en IV subcapítulos, el sub
capítulo I, incluye el estudio del Conflicto Colectivo Laboral, el sub capítulo II, La
negociación colectiva, el sub capítulo III, El arbitraje, y el sub capítulo IV, El arbitraje
potestativo; el capítulo III, desarrolla los materiales y métodos utilizados referidos al tipo
y diseño de la investigación, así como el material de estudio, métodos, recolección y
procesamiento de datos; finalmente, el capítulo IV, que comprende las conclusiones a las
que se llegó en este trabajo de investigación y las recomendaciones. Para el avance del
trabajo investigación, se realizó un exhaustivo análisis doctrinario y legislativo, así como
a la jurisprudencia para su mejor comprensión de las relaciones laborales entre
trabajadores y empleadores.
The present research work entitled ““Potential arbitration as an ineffective mechanism in collective bargaining““ arises out of concern that arbitration is unilaterally imposed by the worker or employer, within the labor bond. What belonged to both of you can now be decided by one of the parties, Thus distorting the primary concept of collective bargaining, which consists in reaching agreements through dialogue with a view to resolving a dispute. Potential arbitration thus undermines legal certainty by harming workers or employers; it subtracts from the role of trade union organizations, who must represent their affiliates in their collective bargaining. This research consists of IV chapters, distributed as follows: chapter I, entitled The problem, which contains the approach to the problem, formulation of the problem, hypotheses, objectives, justification and background of research; Chapter II, called the Theoretical Framework, is subdivided into IV subchapters, Subchapter I, covers the study of the Collective Labour Conflict, Subchapter II, Collective bargaining, Subchapter III, Arbitration, and Subchapter IV, Potential arbitration; Chapter III, develops materials and methods used as the type and design of research, as well as study material, methods, data collection and processing; finally, chapter IV, which includes the conclusions reached in this research work and recommendations. For the development of this research work, a thorough doctrinal and legislative analysis was carried out, as well as jurisprudence to better understand the labor relations between workers and employers.
