This research is to demonstrate that the current law of state contracts doesn´t guarantee effective protection of the selection procedure in cases where the appeal is resolved by the hold of the public body violates the principles of transparency and impartiality, and it´s necessary to take into account the theories that regulate these principles and develop them to define our hypothesis. Through methods and methodological procedures it has allowed us to analyze the problem raised, with the use of descriptive research. While it is true that the legislature has chosen to entrust the resolution of certain questions to the same entity, it is inevitable to take appropriate measures to detect, reduce and sanction the possibilities of influence in such decisions. The main conclusion reached is to propose an amendment to the legislation, which respects the principles of transparency and impartiality, so that there needs to be only one independent administrative body for the review of the decisions of public entities such as the State Procurement Tribunal, improving the satisfaction of those interested in the outcome of the procurement.
