The right to bank compensation is recognized by subsection 11 of article 132 of Law No. 26702- General Law of the Financial System and the Insurance System and Organic Law of the Superintendence of Baking and Insurance, which refers to the power that financial entities have to compensate between the debtor's credits and assets. that they keep in their possession, as long as these do not correspond to those assets legally or contractually declared intangible or excluded from this right. From this perspective, this right can generate some controversy with another right, which refers to remuneration; since, according to one position, remuneration would be included within the in fine part of the aforementioned article, for which reason financial entities could not apply compensation in an unrestricted manner; however, there is another position that weighs the right of banks to compensate without observing limitations in the case of remuneration. Thus, since its condition is not expressly established, a doubt arises as to which is the criterion to be adopted for the application of such figure; however, such doubt has not yet been resolved, since INDECOPI continues to issue different criteria with respect to the same assumption. Thus, the discussion arises as to how the changes in the interpretation of bank compensation in INDECOPI resolutions affect the principle of legal certainty of Peruvian consumers and suppliers. In this sense, to analyze the problem, an applied and descriptive investigation was chosen, using as instruments a checklist of the resolutions issued by INDECOPI on bank compensation and interview files to specialists in the subject. Thus, by means of the present research, it is intended to propose a greater safeguard for the persons administered; therefore, it is recommended the creation of a law that serves to set parameters of interpretation and application of the bank compensation in the remunerations, because as it has been elucidated, the incorporation of such parameters will allow to obtain a uniform interpretative criterion, and in this way, to grant greater legal security to the persons administered.
