This thesis has been carried out with the purpose of determining the legal foundations to regulate the de facto union recognized as a cause of marriage impediment in Peru for the year 2023. The research approach is based on qualitative analysis, using a survey as main study technique. The research design is classified as non-experimental and is characterized by being basic and descriptive. The research focuses on the protection of the rights and expectations of cohabitants, as well as the preservation of the cohabiting family. The results obtained indicate the need to modify the Civil Code to include the de facto union recognized as an absolute marital impediment, supported by constitutional principles and comparative legislation. The comparison with the legislation of other countries, such as Guatemala, Chile and Bolivia, reinforces the importance of guaranteeing the stability of relationships and respect for formal and informal unions. Finally, the relevance of making legal adjustments to address these situations in an equitable and consistent manner with constitutional principles is highlighted, with the aim of achieving comprehensive protection of the rights of those who choose de facto union as a form of coexistence. The legislative proposal presented, which advocates the modification of article 241 of the Civil Code to include de facto union recognized as an absolute marital impediment, reinforces this call for legal adaptation. This modification seeks to effectively protect the rights and expectations of cohabitants, thus contributing to the construction of a legal framework that more precisely adjusts to current forms of family coexistence
