Análisis del proceso de contratación en el marco G2G para la Asistencia Técnica del proyecto del Aeropuerto Internacional de Cusco

Abstract

Este estudio titulado “Análisis del proceso de contratación en el marco G2G para la asistencia técnica del proyecto del aeropuerto internacional de Cusco” es de tipo descriptivo Correlacional, tiene como objetivo principal analizar el proceso de contratación que realizo el Ministerio de Transportes y Comunicaciones en representación del Estado Peruano y KOTRA-KAC en representación del Gobierno de Corea del Sur en el año 2019. La metodología usada para esta investigación fue el análisis documental de toda la información publicada en el SEACE referente a este proceso de contratación, además de ello están los documentos solicitados al MTC mediante el acceso de información pública de acuerdo a la Ley N° 27806 y toda la información recabada de fuentes como el banco de proyectos, los reportes de seguimiento a la ejecución de la inversión y otros. Siendo un tipo de contratación diferente el marco G2G o acuerdo de gobierno a gobierno las disposiciones de la Ley de contrataciones del Estado no le son aplicables, éste se rige bajo la vigésima primera disposición complementaria final del texto único ordenado de la ley 30225 donde menciona que esta contratación se regula por normas y principios del derecho internacional, cumpliendo lo mencionado, como primer paso nuestro país declaró de interés nacional el objeto de contratación de este proyecto con Decreto Supremo 021-2019-MTC, realizándose una indagación de mercado donde cinco países resultaron interesados en brindar la asistencia técnica para la ejecución del aeropuerto de Chincheros, siendo ellos Francia, Turquía, Canadá, España y Corea del Sur, siendo este último el Estado ganador y celebrando contrato con nuestro gobierno el 24 de octubre del 2019 por un monto de $ 30,194,389.00 iv (Treinta millones ciento noventa y cuatro mil trescientos ochenta y nueve con 00/100 dólares) y teniendo como plazo de ejecución de cinco años, iniciando en noviembre del 2019 y terminando en octubre del 2024. Las bases administrativas establecidas en el proceso de contratación limitan su desarrollo en cuatro fases, siendo la fase 01- Revisión del EDI, fase 02- Procura Internacional, fase 03- Gestion de contratos del proyecto y fase 04- Puesta en operación. El proyecto aún se encuentra en ejecución, siendo los ganadores de la fase 2 del proceso de adjudicación el Consorcio AICC responsable de la supervisión y el Consorcio Natividad de Chincheros encargado de la ejecución. Actualmente, el proyecto se encuentra en la Fase 3 del ciclo de vida, donde el Gobierno de Corea del Sur a través de su PMO (Oficina de Gestión de proyectos) viene brindando asistencia técnica, monitoreo y control oportuno referente a la ejecución y supervisión del proyecto del aeropuerto de Chincheros – Cusco

This study entitled ““Analysis of the contracting process in the G2G framework for the technical assistance of the Cusco international airport project““ is of a descriptive Correlational type, its main objective is to analyze the contracting process carried out by the Ministry of Transport and Communications on behalf of of the Peruvian State and KOTRA-KAC on behalf of the Government of South Korea in 2019. The methodology used for this investigation was the documentary analysis of all the information published in SEACE regarding this contracting process, in addition to this there are the documents requested from the MTC through access to public information in accordance with Law No. 27806 and all the information collected from sources such as the project bank, follow-up reports on the execution of the investment and others. As the G2G framework or government-to-government agreement is a different type of contracting, the provisions of the State Procurement Law are not applicable to it, it is governed by the twenty-first final complementary provision of the single ordered text of Law 30225 where it mentions that This contracting is regulated by norms and principles of international law, complying with the aforementioned, as a first step our country declared the object of contracting this project to be of national interest with Supreme Decree 021-2019-MTC, carrying out a market investigation where five countries were found to be interested in providing technical assistance for the execution of the Chincheros airport, being France, Turkey, Canada, Spain and South Korea, the latter being the winning State and celebrating a contract with our government on October 24, 2019 for an amount of $30,194,389.00 (Thirty million one hundred ninety-four thousand vi three hundred eighty-nine with 00/100 dollars) and teni The execution period is five years, starting in November 2019 and ending in October 2024.
