This study aims to determine why, despite the existence of the Notarial route as a mechanism for the resolution of non-contentious processes, part of the population still chooses the judicial route for resolving these matters, causing at least minimal reduction in the judicial workload in Trujillo's Judicial Power during the year 2023. Thus, the following question will be addressed as the problem statement: What are the reasons why non-contentious processes such as intestate succession, correction of records, and family heritage, via notarial channels, do not contribute to reducing the judicial workload in the Judicial Power in Trujillo during the 2023 period? The concept of non-contentious processes and their importance in the Peruvian legal system will be examined. These processes, also known as non-litigious procedures, are characterized by not involving disputes between parties and by seeking quick and efficient solutions to resolve different legal matters. Additionally, the role of notaries in processing the mentioned main non-contentious processes will be analyzed. Notaries in Peru have the authority to carry out a series of legal functions, including the processing and resolution of non-contentious processes. This implies that citizens can turn to a notary to resolve their issues more quickly and with less bureaucracy than if they had to resort to the Judicial Power. However, despite the existence of the notarial route for processing these non- contentious processes, the research highlights that this alternative has not significantly contributed to reducing the judicial workload in the Peruvian Judicial Power. The main factor analyzed for why non-contentious processes such as intestate succession, correction of records, and Family heritage, via notarial channels, do not contribute to reducing the judicial workload in the Judicial Power in Trujillo during the 2023 period is the lack of economic resources on the part of society to access this route. 7 Finally, recommendations and possible solutions are proposed to improve the situation.
