The present thesis report focused as a general objective to determine if legally and factually the enforceability of the unregistered property right of the third party against the preventive annotation of the embargo in public records by the creditor. In the information gathering stage for the elaboration of the chapters of the theoretical framework, the sources of consultation were used, such as books, legal journals and national and comparative legislation, using in the data collection the techniques of the signing and as a collection instrument. of data, the files of a qualitative research were used. Regarding the results of the research developed in the chapters of the theoretical framework, it was obtained that the factual grounds of why the third party's nonregistered third-party effectiveness against the embargo registered in public records is not based on the malicious omission of registration and the proliferation of false documents; while in the legal area there is French and Italian law as well as wellknown national jurists in which the non-registered property is not allowed to be enforced against the inscribed embargo. The main conclusion of the research work is that the enforceability of the nonregistered property right of the third party against the preventive annotation of the embargo in the public records by the creditor is not legally admissible because the registered right must always prevail regardless of the nature of the real or personal right, and factual because it allows the proliferation of fraudulent acts, it is recommended the legislative amendment of article 2022 of the civil code to give priority to the registered right.
