The thesis that we have called “Need to regulate pre-contractual liability as a result of the unjustified rupture of preliminary treatment, from the regulatory deficiency of Article 1362 of the Peruvian Civil Code“, is directed to the determination to substantiate the necessary legal elements to propose the legal regulation of this important legal figure, in order to have a fully recognized institution at the level of our legal system. In this sense, the formulation of our Problem was the following: TO WHAT EXTENT IS IT NECESSARY TO REGULATE THE FIGURE OF THE PRECONTRACTUAL RESPONSIBILITY WITH THE PURPOSE OF OVERCOMING THE NORMATIVE DEFICIENCY AT THE LEVEL OF ART. 1362 OF THE CIVIL CODE, REGARDING THE RECOVERY OF DAMAGES CAUSED AS A RESULT OF THE UNJUSTIFIED BREAKDOWN OF PRELIMINARY TREATMENTS? In application of the logical and legal methods, and considering the fundamentals exposed in the results, jurisprudence, comparative legislation and interviews, it has been concluded that it is convenient to introduce in our civil order a legal reform that does not allow to leave devoid of action for request compensation for those damages suffered by one of the traffickers by the action of its counterpart who violates the principle of good faith and loyalty, unjustifiably leaving the negotiations, generating a fraud of exceptions based on the conclusion of a business legal.
