This thesis titled: ““Article 339.1 of the Criminal Procedure Code and the actions of the Public Ministry that interrupt the prescription of prosecution in the Judicial District of La Libertad in the years 2011-2014““; addresses the issue about determining if the application of Article 339º.1 the Criminal Procedure Code denatures performances that disrupt public prosecutor for criminal proceedings in the judicial district of La Libertad in the years 2011- 2014. To formulate and contrast our hypotheses that: ““The application of Article 339º.1 the Criminal Procedure Code denatures performances that disrupt public prosecutor for criminal proceedings in the judicial district of La Libertad in the years 2011-2014 to the extent that eliminates the only possibility of interrupting the prosecution by public prosecution ““has been used developed in the Theoretical Framework, thematic and criminal action, prescription of prosecution and the interruption and suspension of prosecution, has been used In addition, hermeneutical, deductive, inductive methods of synthesis and analysis of resolutions on prescription of criminal action issued during the years 2011-2014 in the courts of preliminary investigation, Collegiate Courts and Criminal Chambers Judicial District of Liberty, as well as analysis of Plenum of the Supreme Court of limitations for criminal proceedings, as decisions of other judicial districts implementing the new Criminal Procedure Code. This research has concluded that the application of Article 339º.1 the Criminal Procedure Code has distorted the traditional and widely accepted conception of the Proceedings of the Public Ministry to interrupt the prosecution, which constitutes the formalization of the preliminary investigation, constituting this act in the main event promotion and formal exercise of criminal action the Public Ministry, since it is communicated to the preliminary investigation judge and that is where the criminal proceedings judicializa itself.
