Implementación de un órgano auxiliar de supervisión de las medidas de protección dictadas en los procesos de violencia familiar a fin de garantizar su real cumplimiento

Abstract

La tesis que hemos denominado “IMPLEMENTACIÓN DE UN ÓRGANO AUXILIAR DE SUPERVISIÓN DE LAS MEDIDAS DE PROTECCIÓN DICTADAS EN LOS PROCESOS DE VIOLENCIA FAMILIAR”, responde a la necesidad de proteger a la víctima de violencia familiar y a su vez que cese o desaparezca la violencia dentro del grupo familiar y la sociedad. En este sentido, la formulación de nuestro problema es el siguiente: ¿EXISTE LA NECESIDAD DE IMPLEMENTAR UN ÓRGANO AUXILIAR QUE SUPERVISE LAS MEDIDAS DE PROTECCIÓN DICTADAS A LAS VÍCTIMAS DE VIOLENCIA FAMILIAR EN UN PROCESO JUDICIAL A FIN DE GARANTIZAR SU REAL CUMPLIMIENTO?, para lo cual se ha propuesto la siguiente hipótesis de investigación: Existe la necesidad de implementar un órgano auxiliar que supervise las medidas de protección dictadas a las víctimas de violencia familiar en un proceso judicial a fin de garantizar su real cumplimiento ya que el Estado tiene la obligación de proteger a la familia según la norma constitucional de acuerdo a lo establecido en el artículo 4° de nuestra Constitución Política. A nivel de los objetivos nos hemos propuesto implementar un órgano auxiliar que supervise las medidas de protección dictadas a las víctimas de violencia familiar en un proceso judicial a fin de se pueda garantizar su real cumplimiento. Con la presente investigación se logró determinar que es importante garantizar la efectividad de las medidas de protección para evitar que la víctima sea violentada nuevamente, se debe establecer sanciones más severas para aquellos que las incumplan, siendo necesario la ayuda de la sociedad en pleno, denunciando los casos de incumplimiento de las medidas de protección, a fin de imponer sanciones efectivas.

Proposed the following research hypothesis: There is a need to implement an auxiliary body that supervises the measures of protection given to victims of domestic violence in a judicial process in order to ensure their true fulfillment, since the State has the obligation to To protect the family according to the constitutional norm according to the established in article 4 of our Political Constitution. At the level of the objectives we have set out to implement an auxiliary body that supervises the measures of protection given to the victims of domestic violence in a judicial process in order to guarantee their real compliance. With the present investigation it was possible to determine that it is important to guarantee the effectiveness of the measures of protection to avoid that the victim is violated again, it is necessary to establish more severe penalties for those that fail them, being necessary the help of the society in full, denouncing Cases of non-compliance with the protection measures, in order to impose effective sanctions.
