This thesis work entitled “Incorporation of the certiorari in the Constitutional tort appeal in the Peruvian constitutional system”, had as general objective to determinate if the Constitutional tort appeal is insufficient for the Constitutional Court to fulfill its nomofilactic function and unifying function of the constitutional cases law. To achieve this, a study was made of both its independent variable, that is, the Constitutional tort appeal, and the dependent variable, that is, the nomofilactic function and unifying function of the constitutional cases law of the Constitutional Court; as well as the figure of the certiorari. In the development of the research work, bibliographical sources, national legal regulations and comparative law were consulted, as well as pronouncements of the Constitutional Court. Finally, as the main conclusion, we verified the hypothesis initially raised, that is, that the current regulation of the Appeal constitutional tort is insufficient, because incompatible, with the nomofilactic and unifying functions of constitutional jurisprudence, exercised by the Constitutional Court. Consequently, it is necessary that the certiorari be incorporated into the criteria for admission of the Constitutional tort appeal.
