This thesis has been called “Need for regulation of minimum requirements and profile of who are responsible for the selection process in State Contracting Law”. Keeping in mind that this requirement is regulated in Article 5 of the Regulations of the Law on Government Procurement (Supreme Decree No. 184- 2008-EF), however, these are insufficient and bare, so the objectives of this research are: determining the criteria used by holders of state entities in the province of Trujillo, to appoint the members that make up the Special Committee during the years 2012-2015; determining whether these members are certified in public procurement by the OSCE. For meeting this objectives referred to, has been used as population and sample, administrative resolutions designating members of the Special Committee, and surveys of public entities holders in the province of Trujillo. The main results obtained in this research were: the criteria used by public entities to appoint members of the Special Committee, it is based primarily on confidence in the employee. Also, it has been found that the vast majority of members of this collegiate and alternate, are not certified by the OSCE so, it follows that they are not properly trained in procurement. Training and accreditation of officials and servants working in state bodies in public procurement, has been developed in great shape in Panama, taking into consideration the participation of officials in the procurement process. Finally, we note that the disciplinary record, adequate training and experience in procurement issues are criteria that must be estimated by the heads of state bodies and referred to in the regulations on the matter, as requirements for appointing members the Special Committee which will be responsible for conducting the selection process, and enabling the effectiveness of this procedure.
