La filiación del adulto concebido mediante inseminación artificial heteróloga en el derecho familiar peruano.

Abstract

El interés por abordar la presente investigación, titulada “La filiación del adulto concebido mediante inseminación artificial heteróloga en el derecho familiar peruano”, radica en la necesidad de determinar si el estado necesita regular este problema jurídico que nace desde el momento que una persona adulta desea encontrar su verdadera identidad biológica y ve su derechero limitado pues existe un vacío legal acerca del tema de filiación en casos de inseminación artificial heteróloga lo cual genera que no exista un clara perspectiva sobre cuál sería la adecuada decisión por parte de los magistrados, que vulneraria de derechos fundamentales. La identidad es un derecho humano que comprende derechos correlacionados: el derecho a un nombre propio, a conocer la propia historia filial y a la nacionalidad. Como todos los derechos humanos, el derecho a la identidad se deriva de la dignidad inherente al ser humano, razón por la cual le pertenece a todas las personas sin discriminación, estando obligado el Estado a garantizarlo, mediante la ejecución de todos los medios de los que disponga para hacerlo efectivo. Creemos que la importancia de la presente investigación radica en la posibilidad de determinar si el estado debe legislar el vacío legal que existe sobre el tema de filiación en los casos de los adultos nacidos por inseminación artificial heteróloga, pues al tener mayoría de edad, pueden ejercer sus derechos de una manera más amplia, y tienen plena conciencia del deseo de querer conocer su origen biológico, asumiendo las consecuencias que se derivarían de esta decisión.
