The thesis, entitled ““SHORT-TERM INVESTMENTS AND THE RIGHT TO FREEDOM OF TRADE AND INDUSTRY IN PERU““, seeks to conduct a study on the behavior of short-term investments in a given period and its Incidence, the problem of the present project is: short-term capital affected the right to freedom of trade and industry established in Article 59 of the Political Constitution of Peru during the period 2004-2014 ? The hypothesis is stated as follows: short-term capital negatively affected the right to freedom of trade and industry established in Article 59 of the Constitution of Peru during the period 2004-2014. The research according to its purpose is applied, according to its scope is explanatory and according to the research design is non-experimental or descriptive longitudinal. For the preparation of the present study, bibliographical data analysis, data index and interviews with specialists in the subject have been used, they are directed to specialists in constitutional law and in economic and international law. To compile the information, books, scientific journals and specialized web pages were used. Short-term Capitals in the Peruvian economy during the period 2004-2014 increased progressively and this, according to specialists, causes an imbalance in the Peruvian economy, delays and does not generate economic growth, and affects the right to freedom of trade and industry. As a result of the investigation, the following proposal was made: EXTENSION OF ARTICLE 6 OF THE LAW OF INCOME TAX TAX FOR NON DOMICILIANS PERFORMING SHORT-TERM INVESTMENTS IN PERU.
