Abstract: En la actualidad muchas parejas se encuentran biológicamente imposibilitadas
de procrear, debido a problemas de infertilidad. Las cuestiones en torno a la
infertilidad son variadas y complejas, se estima que afecta entre el 16% y 20%
de las parejas, alrededor de noventa y cuatro millones de personas en el
mundo El avance de la ciencia facilita la reproducción humana con las técnicas
de reproducción asistida, con éstas, la fecundación es enteramente realizada
por el médico en un laboratorio, donde el ser humano parece disponer de un
poder casi supremo al crear una nueva vida. Es así que existe una cierta
cantidad de mujeres en edad fértil que por determinados problemas no
producen óvulos o estos no son de buena calidad. Para ellas la única opción de
lograr un embarazo es considerar la ovodonación.
La ovodonación, es una técnica relativamente nueva, aparecida a mediados de
la década del ´80 como una variante de fertilización in Vitro. Es definida como
la aportación de gametos femeninos por una mujer distinta de la que los recibe.
De esta manera se utilizan óvulos de una mujer donante, y se transfieren
embriones obtenidos al útero de la mujer receptora.
Debido a ésta situación el presente trabajo centra su atención en tratar de
establecer y dilucidar la problemática jurídica que se plantea en nuestra
legislación derivada del uso de la Reproducción Humana Asistida en particular
del caso de la (ovodonación) estableciendo al mismo tiempo las alternativas,
propuestas o posibles cambios que se deben realizar en nuestra normativa
vigente porque a los más de veinte años de vigencia de nuestra norma
sustantiva vigente han quedado algunos artículos en des uso encontrándose
vacíos legales frente a las controversias sociales surgidas del avance de la
ciencia en la vida cotidiana y específicamente de las del tema propuesto.
Today many couples are unable to procreate biologically, due to infertility problems. The issues surrounding infertility are varied and complex, is estimated to affect between 16% and 20% of couples, around ninety-four million people in the world The advance of science facilitates human reproductive techniques assisted reproduction, with these, the fertilization is entirely done by the doctor in a lab, where the human being seems to have an almost supreme power to create new life. Thus there is a certain amount of women of childbearing age that certain problems are not producing eggs or they are not good quality. For them the only option to achieve pregnancy is to consider egg donation. The egg donation is a relatively new technique, published in the mid- '80s as a variant of IVF. It is defined as the contribution of female gametes by a woman other than the recipient. In this way a woman uses donor eggs and embryos are transferred to the uterus of the recipient woman. Due to this situation, the present work focuses on trying to establish and clarify the legal issues raised in our civil law from the use of the Assisted Human Reproduction in particular Case (Oocyte Donation) while establishing alternatives, proposed or potential changes that must be made in our current civil legislation because more than twenty years of operation of our existing substantive rule have been some articles in finding loopholes des use against social controversies arising from the advance of science in the everyday life and specifically with the theme
