This thesis performs the study of the exercise of the right to freedom of expression of workers subject to the labor regime of private activity against the use of electronic means currently used; The so called social networks. The relevance of the topic becomes more present since today the use of social networks is no longer just a mechanism to interact and establish interpersonal relationships, often becoming a form of social pressure that depending on the case can bring the collision of fundamental rights for both the employee as well as the employer. The theoretical framework of the thesis is divided into three chapters. The first chapter develops the general notions of an employment relationship, its elements, subjects and the way in which the employment relationship is extinguished; which, for the importance of the investigation, would be the cause of injury and insolence. The second chapter contains the general notions of the constitutional rights of the worker, making a greater impact on the exercise, use and dimensions of the right to freedom of expression. Finally, the third chapter examines the use of the right of freedom of expression by the worker and its connection with social networks, ending with a case of great importance contained in Resolution No. 015-2014-9JET concerning the worker’s confrontation of the rights to freedom of expression vs. the company’s right to the good image and its worker´s good reputation.
