Los asientos registrales extendidos por incorrecta calificación

Abstract

En los últimos años es innegable el rol fundamental que cada día tiene los Registros Públicos para la celebración de actos y contratos en nuestro país, siendo una herramienta de certeza y seguridad jurídica. Es por ello que constantemente se buscan mecanismos que otorguen mayor certeza y confiabilidad. Esta investigación no se aleja de aquel fin y evidencia una problemática a tener en cuenta. En ese sentido, el presente trabajo tiene como objetivo principal determinar si los asientos registrales de inscripción extendidos por una incorrecta calificación afectan a los titulares registrales del registro de predios, (premisa no contemplada por el Registro), teniendo en cuenta que los métodos jurídicos de investigación empleados han sido el doctrinario y la hermenéutica jurídica. Asimismo, además del análisis doctrinario y legislativo, se ha tenido en cuenta las partidas registrales y las resoluciones emitidas por el Tribunal Registral relacionadas a asientos registrales erróneamente extendidos, que permitan determinar los alcances de éstos y verificar las consecuencias que repercuten en el titular registral. Es así que logró concluirse que los asientos registrales extendidos por una incorrecta calificación sí afectan a los titulares registrales puesto que al no existir posibilidad de corrección o advertencia alguna no les permite hacer efectivo su derecho como tal. Además al finalizar el presente trabajo se recomienda implementar un procedimiento especial que permite advertir y tratar de corregir en lo posible, los asientos extendidos por incorrecta calificación, así proteger al titular registral que se vio afectado con dicho error.

In recent years, the fundamental role of Public Registry for the celebration of acts and contracts in our country is undeniable, being a tool of legal certainty. That is why we constantly seek mechanisms that give greater certainty and reliability. This research is not far from that goal and shows a problem to be taken into account. In this sense, the main objective of this investigation is to determine if the registry entries extended by an incorrect qualification affect the registry holders, (premise not contemplated by the Registry), taking into account that the legal methods of investigation used have been Doctrinal and legal hermeneutics. Also, in addition to the doctrinal and legislative analysis, account has been taken of the registry items and the resolutions issued by the Registry Court relating to erroneously extended registration entries, which allow to determine the scope of these and verify the consequences that affect the registry holder. In this way, it was concluded that the registry entries extended by an incorrect qualification affect the registry holders since if there is no possibility of correction or warning, this holders are not able to exercise their right as such. In addition, at the end of the present work, a special procedure has been proposed that allows us to warn and try to correct the extended seats for incorrect qualification, thus protecting the registry holder who was affected by this mistake.
