“Today; Contracting and acquisitions of the State are considered to be one of the critical areas within the public management, which is affected by the major corruption cases, situation that is often caused by officials and servers involved in the process of selection and recruitment that covered in the margin of discretion enabling in performances with the rules on procurement they are relegating the collective interests of General and public in their acts of management and administrative acts, in order to seek private or third party interests. While our public procurement legislation provides that officials and servers, as well as the members of the Special Committee involved in selection and hiring processes are responsible for their enforcement by their acts or omissions, whose proper performance is evaluated by the highest authority of the institution to which they belong, which tests are available and audits specialized empowering them so that in the event of non-compliance , depending on its severity, imposing from a written reprimand, suspension without pay of thirty to ninety days, temporary cessation without remuneration up to twelve months and the dismissal or dismissal; true is also that in such contracts and acquisitions there is the undeniable peculiarity engage in determining liability likely much to officials and public servants with the holder of the entity, which is who should evaluate the performance of the concerned officials and servants.“
