Article 565-A of the Civil Procedure Code requires an additional requirement for admission to the food demand required in cases of reduction, variation, waiver or apportionment of alimony, as is the fact accredit to date in the payment of maintenance. This rule is in principle a form of obstruction fundamental right to effective judicial protection of every citizen, so, the importance of conducting this research seeks to determine how the Art 565 -. A of Civil Procedure Code affects the right to effective judicial protection in the first level of access to the judiciary, as required by the plaintiff (food forced) in the claims for reduction, variation, waiver assessment and food, are current on payments of maintenance. For this we performed summary sheets, review of records and surveyed the Judges of the Courts of Peace Counsel Specializing in Family Sub Trujillo (2nd, 3rd, 6th and 9th). At the end of our study we conclude that the applicable national law, specifically with the enactment of Section 565-A of the CPC, it violates the fundamental right to effective judicial protection of the obligor obligee constituting undoubtedly a limitation, an excess and a irrational and disproportionate to the right of action of the obligor obligee barrier, it should be modified.
