Abstract: La Tesis que he denominado “LA SOBRECRIMINALIZACIÓN EN EL ORDENAMIENTO PENAL NACIONAL”, responde a una imperiosa necesidad de determinar la eficacia que ha tenido la política criminal del Estado para lograr la seguridad ciudadana y convivencia pacífica de los ciudadanos.
En este sentido, la formulación de nuestro Problema es el siguiente: ¿En qué medida la sobrecriminalización de las conductas tipificadas en el Código Penal peruano, ha resultado eficaz para garantizar la seguridad y la convivencia pacífica de los ciudadanos de nuestro país?, para lo cual proponemos la siguiente Hipótesis: La sobrecriminalización de las conductas tipificadas en el código Penal peruano, ha resultado ineficaz para garantizar la seguridad ciudadana y la convivencia pacífica de los ciudadanos de nuestro país, pues el porcentaje delincuencial ha aumentado.
En este orden de ideas, pues, analizando la doctrina y estadísticas, logramos concluir que la política criminal desplegada por el Estado a través del Derecho Penal no ha satisfecho completamente las necesidades de seguridad ciudadana y convivencia pacífica de los ciudadanos de nuestro país, por tanto, el aumento de las penas como se ha podido notar en los distintos gobiernos desde la vigencia del código penal y la sobrecriminalización de los tipos penales no es un camino adecuado para hacer frente al avance de la delincuencia.
Cabe mencionar, a modo de sugerencia, que la constatación de un progresivo aumento de la criminalidad del país, hace necesario recurrir a medidas imaginativas e intersectoriales para luchar contra la delincuencia, enfatizando aspectos preventivos, educacionales y de rehabilitación. Así, proponemos un trabajo sistemático a nivel de los centros de estudios, medios de comunicación e instituciones estatales (Poder Judicial, Ministerio Público, Inpe, Universidades, etc.
The thesis I have called “OVERCRIMINALIZATION IN THE NATIONAL CRIMINAL LEGISLATION“ responds to a pressing need to determine how effective has the criminal policy of the state to ensure public safety and peaceful coexistence of citizens. Thus, the formulation of our problem is as follows: To what extent the overcriminalization of conduct defined in the Peruvian Criminal Code, has been effective in ensuring security and peaceful coexistence of the citizens of our country for what ?, we propose the following hypothesis: the overcriminalization of the acts described in the Peruvian Criminal code, has proved ineffective in ensuring security and peaceful coexistence of the citizens of our country, as the delinquency rate has increased. In this vein, then, analyzing the doctrine and statistics, we conclude that the criminal policy deployed by the state through the criminal law has not fully met the needs of public safety and peaceful living of the citizens of our country, thus the increase in penalties as has been noted in the various governments since the validity of the criminal code and the criminal types overcriminalization is not an appropriate way to address the advancement of crime. It should be mentioned, by way of suggestion, that the finding of a progressive increase in crime in the country, it is necessary to resort to imaginative and intersectoral measures to combat crime, emphasizing preventive, educational and rehabilitative aspects. Thus, we propose a systematic level study centers, media and state institutions (judiciary, prosecutors, INPE, universities, etc.
