The present investigation was born due to the constant news about the consummation of the crime of sexual rape, which raises the doubt if, despite the existence of Law No. 30364 – “law to prevent, punish and eradicate violence against women and the members of the family group”, does not turn out to be efficient as it does not meet its objective. Therefore, considering the Fourth Final and Transitory Provision, and that the Peruvian state, finding itself subject to being investigated and/or accused at an international level in cases where it has violated human rights, and has already been declared internationally responsible for contravening human rights victims of sexual violence, established guidelines that the government must comply with to provide adequate protection. Based on this, it can be observed in this thesis and after having completed the corresponding study, I find myself in the position that this law lacks a correct development for the prevention and care of victims of sexual rape. Ergo, this thesis is an applied and descriptive research, applying methods such as deductive, analytical, hermeneutic and doctrinal, obtaining results as a result of the analysis of two sentences issued by the Inter-American Court where it declares the responsibility of the Peruvian state and the effectiveness of Law No. 30364
