Abstract: El presente trabajo de investigación detenta como objetivo direccionado a poder analizar aspectos referentes a una duración del plazo razonable y si esto vulnera al derecho a un debido proceso, tomándose en cuenta criterios del Tribunal Constitucional, y Corte Interamericana de Derechos Humanos, así también una revisión de la normativa penal, para realizar un estudio integral y completo respecto a temas de la materia, puesto que su vital importancia radica en buscar el equilibrio entre la sociedad y el Estado, dentro de los límites establecidos y que las personas tengan la plena seguridad que de iniciarse un proceso penal en el que estén involucrados se respeten sus derechos fundamentales así como garantías constitucionales, que le asiste a todo ciudadano. Con esto se puede resaltar, la importancia del plazo razonable en todas las etapas del proceso, entiéndase desde el inicio hasta que culminan, lo que garantizaría la protección de los derechos, y aplicando así una justicia rápida, sin dilaciones, que afecten a las partes.
The present research work aims to analyze aspects related to the duration of the reasonable term and whether this violates the right to due process, taking into account the criteria of the Constitutional Court and the Inter-American Court of Human Rights, as well as a review of the criminal law, to carry out an integral and complete study on the subject, since its vital importance lies in seeking a balance between society and the State, within the established limits and that people have the full assurance that if a criminal process is initiated in which they are involved, their fundamental rights are respected as well as constitutional guarantees, which every citizen is entitled to. With this we can highlight the importance of reasonable time in all stages of the process, from the beginning to the end, which would ensure the protection of rights, and thus applying a swift justice, without delays, affecting the parties.
