Abstract: El proceso penal en el Perú se presenta mediante la estructura del proceso común, esto es, de la presencia de un conjunto de actos procesales de los sujetos adscritos al proceso en tres fases en el siguiente orden: investigación preparatoria, etapa intermedia y juzgamiento, por lo que es importante para el éxito del proceso que la acusación sea válida y fuerte, pues el principio acusatorio indica que no puede haber sentencia sin acusación, por lo que la acusación una vez que ´pasa el filtro de la etapa intermedia no puede mutable, sin embargo, la única excepción la constituye la “acusación complementaria”, la misma que, según el Código Procesal penal opera durante “durante el juicio”, prescripción normativa que merece un interpretación habida cuenta el juicio es una etapa extensa, por lo que, en la investigación se estableció cual era el momento en el que se puede presentar esta acusación y hasta que momento ello se puede hacer.
En relación a lo señalado en el párrafo anterior es que se señaló como enunciado del problema el siguiente: “¿Cuál debe ser la oportunidad para la presentación de la acusación complementaria en el proceso penal peruano?, se propuso como objetivo general el siguiente: “Determinar cuál debe ser la oportunidad para la presentación de la acusación complementaria en el proceso penal peruano”, en razón de ello se analizó la doctrina y la jurisprudencia y aplicando los métodos hermenéutico, doctrinario y comparativo se llegó a los resultados que luego permitieron validar de forma positiva la hipótesis.
