The present research work was developed with the objective of analyzing if the non regulation of the Probationary Sanitation Stage in the ordinary labor process affects the parties. Regarding the methodology used, the research is basic, it corresponds to the descriptive level, the fundamental theory was obtained as a research design, the researcher opted for the qualitative approach seeking to understand the phenomena that are linked to the evidentiary sanitation, making an exploration according to the point of view of the population of labor lawyers of the Judicial District of Piura and with a sample of 8 participants, showing as a result that the legal operators express their desire that the Probationary Sanitation be incorporated in a strict manner in the New Procedural Law, concluding that the regulation of the evidentiary reorganization, affects the parties because they maintain uncertainty by not knowing if the means of evidence they offer will be admitted and valued in the sentence, which will be known until the issuance of said resolution, on the other hand and will enhance the process could be affected nullified if the judge used as support for his sentence a medi or evidence questioned
