Las transferencias sucesivas de mala fe de un bien Inmueble entre amigos y familiares que afectan el derecho de propiedad en los Procesos de nulidad de acto jurídico en el distrito judicial de La Libertad, 2020

Abstract

El presente trabajo de investigación expone una de las principales problemáticas de las relaciones familiares en nuestro ordenamiento jurídico, denominado: “LAS TRANSFERENCIAS SUCESIVAS DE MALA FE DE UN BIEN INMUEBLE ENTRE AMIGOS Y FAMILIARES QUE AFECTAN EL DERECHO DE PROPIEDAD EN LOS PROCESOS DE NULIDAD DE ACTO JURÍDICO EN EL DISTRITO JUDICIAL DE LA LIBERTAD, 2020”; temática que se viene discutiendo arduamente en la doctrina y jurisprudencia nacional como hemos referido sobre los principales derechos de las partes respecto a las transferencias sucesivas de propiedad realizadas por mala fe. Asimismo, la metodología empleada es del método científico que implicará la observación y descripción de la figura jurídica de la transferencia sucesiva de propiedad por mala fe, sin influir en dicha figura bajo ninguna circunstancia. Por otro lado, expondremos los principales resultados de la importancia de la regulación de la figura jurídica antes referida, para establecer conclusiones idóneas sobre la importante necesidad de su regulación y sus consecuencias legales en nuestro país.

The present research work exposes one of the main problems of family relationships in our legal system, called: ““SUCCESSIVE BAD FAITH TRANSFERS OF REAL ESTATE BETWEEN FRIENDS AND RELATIVES THAT AFFECT THE RIGHT OF OWNERSHIP IN LEGAL NULLITY PROCEEDINGS IN THE JUDICIAL DISTRICT OF LA LIBERTAD, 2020 ““; a subject that has been arduously discussed in the doctrine and national jurisprudence as we have referred to the main rights of the parties with respect to successive transfers of property made in bad faith. Likewise, the methodology used is of the scientific method that will involve the observation and description of the legal figure of the successive transfer of ownership due to bad faith, without influencing such figure under any circumstances. On the other hand, we will expose the main results of the importance of the regulation of the aforementioned legal figure, in order to establish suitable conclusions on the important need for its regulation and its legal consequences in our country.
