The present investigation touches on a highly debated topic in dogmatics and judicial practice, since it has even been the subject of debate by well-known doctrinaires and legal operators of the Peruvian criminal process; This investigation is entitled: “The legal prohibition of imposing a suspended sentence in the event of attacks against women and members of the family group and minor injuries.“ That it seeks to determine which legal principles are affected by the legal prohibition of imposing a suspended sentence for cases of aggression against women and members of the family group and minor injuries. The methods used in this research obey logical methods, following a deductive, analytical-synthetic and comparative analysis, we have also resorted to legal methods in which they allow us to interpret the penal code hermeneutically. At the same time that through the doctrinal method we select the positions that adjust to our positions, in this line the dialectical method and the method of economic analysis follow. The main conclusion reached by our research refers that the principle of judicial autonomy implies the subject of the judge only to the constitution, and to the law as long as it does not contradict the constitutional order, so that no judge can be the object of interference.
