The research work developed in this document, entitled “Impossibility of applying harsher penalties to juvenile offenders because it is not an effective solution to achieve their resocialization and crime prevention in Peru““ aims to demonstrate that awarding harsher penalties to juvenile offenders does not generate a deterrent or preventive impact on them. Consequently, the problem posed in this paper is: Is the application of harsher penalties to juvenile offenders an effective solution to achieve their resocialization and crime prevention in Peru? This leads to the hypothesis: ““It is not possible to apply harsher penalties to juvenile offenders because it is not an effective solution to achieve their resocialization and crime prevention in Peru, since it does not have a long-term deterrent impact and affects their physical and mental health and their school development““. For this reason, the aforementioned problem is approached using different logical and rational methods, such as the deductive, inductive and analytical method. Likewise, we have proceeded to work with legal methods such as the hermeneutic and dogmatic method in order to analyze and interpret the main theoretical bases selected in this work. Regarding the methods to collect and process data and information, bibliographic and documentary analysis has been used through different sources such as: books, reports, theses, newspaper articles, among others. Thus, it was concluded that the application of more drastic sanctions to juvenile offenders does not favor their reintegration or development, nor is it a dissuasive or preventive measure, since they do not have this effect on minors, but can cause problems in their studies, physical and mental health, in their development and even in the opportunities to which they may have access throughout their lives. For these reasons, the following pages will describe the selected study variables that should be analyzed on a theoretical basis before concluding on the imposition of drastic measures; for example, it is essential to take into consideration factors such as the family environment in which these adolescents develop, their 8 socioeconomic situation, educational level and mental health, both of the minor and of the members of his or her family group, among other factors. Likewise, the possible solutions and applicable sanctions will be analyzed in order to not only impose a socio-educational measure on the juvenile offender, but also to ensure that prevention is effective in avoiding recidivism, allowing him to learn and improve the adverse circumstances he faces, providing him with opportunities for growth in the various areas of his personal life, as well as all the plausible tools to achieve this purpose.
