This thesis is entitled ““Legal foundations to adequately assess the refusal of the defendant to the biological DNA test, in the processes of challenging extramarital paternity““, which has been oriented to publicize the reasons why it should be normatively regulate legal criteria to assess the refusal of the defendant to the practice of DNA biological testing, in the processes of challenging paternity, was proposed as a statement of my problem: What are the legal grounds to adequately assess the refusal of the defendant to the biological DNA test, in the proceedings challenging extramarital paternity? Being its hypothesis as follows: ““the legal grounds to adequately assess the defendant's refusal to the biological DNA test in the processes of challenging extramarital paternity, the best interests of the child and adolescent and the right to identity”. To analyze the problem, logical and legal methods are used; first, position deduction and induction; and as legal methods dogma, interpretation and comparison are used. The techniques used are the bibliographic analysis and the analysis of documents and the interview; On the other hand, the tools used are bibliographic records, document analysis and interview guides. Finally, it was possible to reach the following general conclusion: ““The legal grounds to adequately assess the defendant's refusal to take a biological DNA test, in the processes of challenging extramarital paternity are the best interests of the child, the assessment adequate means of proof, due process and the fundamental right to identity
