Abstract: La presente investigación toca uno de los problemas observados y harto
discutidos en el sistema de administración de justicia al que hemos denominado
“LAS EXCEPCIONES DURANTE LA ETAPA DE JUZGAMIENTO EN EL
PROCESO PENAL PERUANO”
El presente trabajo se centra en determinar cuáles son las razones jurídicas
que permitirían la interposición de las excepciones en la fase de juzgamiento del
proceso penal peruano, habida cuenta que en la doctrina nacional solo se ha
seguido lo que la ley señala y los fundamentos repetitivos que sustentan que solo
se puede interponer las excepciones antes del juicio en función del principio de
preclusión de los actos procesales.
Partiendo de un entendimiento distinto del principio de preclusión procesal,
además teniendo como fundamentos la legislación comparada y la jurisprudencia
que, aunque es incipiente de la Corte Suprema respecto a la facultad de deducir
excepciones en etapa de juicio es que proponemos que se tal posibilidad es viable
teniendo como principio básico el de economía procesal
The present investigation touches on one of the problems observed and widely discussed in the justice administration system, which we have called ““EXCEPTIONS DURING THE JUDGMENT STAGE IN THE PERUVIAN CRIMINAL PROCESS““ The present work focuses on determining what are the legal reasons that would allow the interposition of exceptions in the trial phase of the Peruvian criminal process, given that in the national doctrine only what the law indicates has been followed and the repetitive foundations that They maintain that exceptions can only be filed before the trial based on the principle of preclusion of procedural acts. Starting from a different understanding of the principle of procedural preclusion, also having as foundations the comparative legislation and the jurisprudence that, although it is incipient of the Supreme Court regarding the power to deduce exceptions in the trial stage, we propose that such a possibility is viable. having as a basic principle that of procedural economy
