This research is aimed at studying the formalization of the complaint for omission to family assistance and its relationship with parental authority; specifically with the objective of determining whether such formalization could be configured as a ground for suspension of the aforementioned family institution; In this sense, it was presented as a statement of the problem: What grounds will support the regulation of the formalization of denunciation for omission to family assistance, as a cause for suspension of parental authority? To determine and solve the proposed problem, a non-experimental research has been carried out, which starts from exploring the dogmatics built around the formalization of the complaint for omission to family assistance, focusing on auscultating the nature and development of the figure of parental authority, as well as counterposing a proposed solution to the problem that arises in its application. For this we rely mainly on the study of criminal and family doctrine; all this in order to elucidate the aspects that are still ambiguous and obscure on one of the most controversial issues of family law, such as the figure of parental authority and its grounds for suspension. The study concludes that the best interests of the child, the constitutional right to food and the dignity of the foodist as a human person; These are grounds that will support the regulation of the formalization of complaints for omission to family assistance, as a cause for suspension of parental authority.
