This research work is focused on the analysis of article 275 paragraph 1 of the new Code of Criminal Procedure, which it is about the figure of the ““non-computation of the term of preventive custody““. In this matter, we find a mistake by not establishing a time limit for its interposition within the criminal prosecution, often even allowing an extensive interpretation of the rule. In this sense, the following statement of the problem was raised: Is it necessary for the rule to establish a time limit for interposing the ““non-computation of the term of preventive custody““? According to our study, it is necessary for the law to establish parameters for the use of the ““non-computation of the term of preventive custody““, since the lack of a time limit for the expiration of this figure would generate a perverse use at the free discretion of the Attorney´s Office. The general objective was to determine whether it is necessary for the rule to establish an expiration term, therefore it was necessary to conduct a doctrinal and jurisprudential analysis, in addition to analyzing a figure very similar to the ““non computation““ as is the ““replacement of term““, both having the same common denominator which is to restore the time and seek the same object and purpose applied in different contexts, so that we can finally prove our hypothesis and reach our conclusions by raising the necessary recommendations.
