Abstract: En la actualidad resulta controversial abordar el denominado Síndrome de
Alienación Parental debido a que existen posturas confrontadas, algunos países
reconocen de manera expresa en sus dispositivos legales, otros tratan de
regularlo de manera implícita, pero no son precisos; sin embargo, existe la
certeza de la vigencia de este síndrome en la vida cotidiana a nivel internacional
y nacional, que incide directamente vulnerando los derechos fundamentales del
niño y/o adolescente, por ello la presente investigación pretende profundizar los
estudios respecto a la necesidad de regular el desarrollo del Síndrome de
Alienación Parental en la legislación peruana como un presupuesto de violencia
psicológica con la finalidad de garantizar los derechos del niño y/o adolescente.
En esa línea, la presente investigación titulada “El Síndrome de Alienación
Parental como presupuesto del delito de violencia psicológica en el Perú”
tiene como objetivo analizar y determinar la relación del Síndrome de Alienación
Parental con la violencia psicológica. La investigación por el tipo de orientación
o finalidad es básica, de acuerdo a la técnica de contrastación es no
experimental, de enfoque cualitativo, con diseño no experimental de tipo
descriptivo.
En la presente investigación se utilizó la técnica de la entrevista, donde la
población estuvo constituida por operadores del derecho especialistas en
derecho de familia y psicología, además de normatividad y legislación
comparada; se aplicó el instrumento de guías de entrevistas a la muestra
conformada por 05 especialistas legales judiciales, 05 fiscales, 05 abogados
litigantes, todos ellos especialistas en derecho de familia y 05 psicólogos.
Asimismo, las técnicas que se aplicaron en la presente investigación son: técnica
de la entrevista, mediante su instrumento de guías de entrevistas; técnica de
recopilación documental, utilizando como instrumento las guías de análisis
documental; técnica de observación, a través de guías de observación. Respecto
de los métodos utilizados para desarrollar la presente investigación se utilizó el
método científico; métodos lógicos, como el método analítico, inductivo,
deductivo, comparativo, método sintético, estadístico; y métodos jurídicos, como
el método hermenéutico, dogmático, exegético, literal.

El desarrollo de la presente investigación arribó como conclusión, que en efecto,
el desarrollo del Síndrome de Alienación Parental constituye un presupuesto de
violencia psicológica, porque genera afectación psicológica y jurídica,
vulnerando los derechos fundamentales del niño y/o adolescentes, como el
derecho a tener una familia y no ser separado de ella, el derecho a la integridad
psicológica, y el derecho al libre desarrollo de la personalidad
Currently some countries recognize Parental Alienation Syndrome, others try to include it in their legislation but are not precise, the truth is that there is certainty of the validity of this syndrome in daily life at an international and national level, which directly affects violating the fundamental rights of the child and/or adolescent, therefore this research aims to deepen the studies regarding the need to regulate the Parental Alienation Syndrome in Peruvian legislation as a budget of psychological violence to guarantee the rights of the child and/or Teen. Along these lines, the present research titled “Parental Alienation Syndrome as a presumption of the crime of psychological violence in Peru” aims to analyze and determine the relationship of Parental Alienation Syndrome with psychological violence. The research by type of orientation or purpose is basic, according to the contrast technique it is non-experimental, with a qualitative approach, with a non-experimental design of a descriptive type. In this research, the interview technique was used, where the population was made up of legal operators specializing in family law and psychology, as well as regulations and comparative legislation; The instrument of interview guides was applied to the sample made up of 05 judicial legal specialists, 05 prosecutors, 05 trial lawyers, all of them specialists in family law and 05 psychologists. Likewise, the techniques that were applied in this research are: interview technique, through its instrument of interview guides; documentary collection technique, using documentary analysis guides as an instrument; observation technique, through observation guides. Regarding the methods used to develop this research, the scientific method was used; logical methods, such as the analytical, inductive, deductive, comparative method, synthetic, statistical method; and legal methods, such as the hermeneutical, dogmatic, exegetical, literal method.
