The purpose of the investigation was to determine if the issuance of a law that regulates surrogacy in the civil legal system would protect the rights of the collaborating pregnant woman, in a pregnancy with assisted reproduction techniques. To resolve this statement, he resorted to the documentary analysis technique consisting of the review of the doctrine and comparative legislation to identify its development and position regarding the application of the assisted reproduction technique of surrogate motherhood and its different modalities. Likewise, the survey was used as an instrument based on a questionnaire to judges specialized in family matters, as well as health professionals such as obstetricians and gynecologists who gave their opinion regarding the need to regulate surrogate motherhood to protect the rights of the surrogate mother. Since this research is necessary to apply a regulation that protects the rights of the collaborating pregnant woman, such as the right to dignity, to grant her medical assistance to integrate her physical and mental health, before, during and after pregnancy with the intention of protecting life and health of the collaborating surrogate mother by introducing the figure of surrogate motherhood within the legal system through the modification of article 7 of the General Health Law and article 361 of the Civil Code (filiation) modifications that are incorporated as a recommendation and bill of modification
