The present investigation entitled ““Legal grounds for regulating the immediate process within the military criminal field in cases of the crime of desertion““. The objective of this research was to determine which are the legal foundations to expressly regulate the immediate process within the military criminal field in cases of desertion. The research according to its orientation is basic, according to the contrast technique it is descriptive, with a non-experimental research design. Likewise, the population and sample used were a prosecutor and a judge of the Military Police Court of the province of Trujillo. In addition, of a case relapsed in the fiscal file n°0135-2016-01-06 on the crime of desertion. Having as techniques the following: the technique of reading with its instrument the reasoning, the technique of documentary collection and analysis with its instrument of documentary analysis guide and the technique of the interview with its instrument the questionnaire with questions duly designed for the present investigation. Now, with respect to the methods, we have the deductive, historical and hermeneutic. Thus, the conclusion is that the legal grounds to expressly regulate the immediate process within the military criminal sphere in cases of the crime of desertion are: Sufficiency of elements of conviction in the crime of desertion, the need to ensure effective justice in the military sphere, lightening of procedural burden and the need to maintain discipline and efficiency in the military forces.
