This investigation develops the issue related to the Period of Suspension of the Limitation of Criminal Action for the Formalization of Preparatory Investigation established in plenary agreement No. 3-2012/CJ-116 in safeguarding the rights and procedural principles recognized to any person immersed in criminal proceedings, which was analysed from the doctrinal, jurisprudence and specialist perspectives, resulting in, in the face of the question of itself, that suspensory period is correct under that plenary agreement, obtaining as a direct and essential result that it is not; that is not incorrect, showing, among other arguments, that it has doubled extraordinary limitation periods. As in all research, in this thesis we apply various methods of research such as scientific, logical or general methods, as well as legal methods; similarly, because of their rigorousness we use techniques with their respective instruments, highlighting primarily those related to the collection of documents and the interview applied to different specialists, in order to obtain relevant and special information that support our results. The results achieved, rigorously analyzed and discussed, not only broadly support the reality warned and exposed but also shape our position to show that the limitation suspension period for the formalization contained in the plenary under study is incorrect, specifically in accordance with its eleventh legal basis, in providing for a time limit for suspension, but does not prescribe the restart of the calculation of the prescription , which goes over its literal limits, in that regard, it is necessary to clarify the plenary because there are gaps left or to modify and incorporate a reasonable period of suspension into that procedural rule through legislative reform. At the conclusion of the investigation, we have made conclusions and various suggestions with the aim of contributing to a change, on the period of suspension of the limitation period as a result of formalizing and thereby constitutionally guaranteeing the procedural principles, reasonable time, due process and presuming himself innocent to the accused in a criminal trial
