Abstract: En la tesis se analizó: “LA PÉRDIDA DE CHANCE COMO DAÑO
INDEMNIZABLE EN EL CÓDIGO CIVIL PERUANO”, entendiéndose a la
pérdida de chance como la ausencia de una posibilidad sensata y objetiva de
un evento beneficioso; sin embargo, su reconocimiento a nivel legislativo en la
legislación peruana -al parecer generaría duda su regulación-, pues las
pretensiones que tienen ese objeto como pretensión son desestimadas por los
órganos jurisdiccionales. De allí nuestro planteamiento al sugerir que la pérdida
de chance sería un daño indemnizable reconocido en el Código Civil Peruano.
La hipótesis permitió un planteamiento de afirmar que la pérdida de chance sí
es indemnizable como daño en el Código Civil Peruano, y, que sí estaría
regulada implícitamente en el artículo 1985° del cuerpo sustantivo; en tal
sentido, la denegación de éste concepto con el argumento de la ausencia de
regulación sería ilegal y hasta podría tornarse en arbitrario; por lo que su
acogimiento debería ser obligatorio, no para su estimación per se o de manera
automática, sino para un análisis de fundabilidad o infundabilidad.
En ese sentido, la presente tesis busca ser una herramienta no solo para los
abogados sino también para los Jueces, que les ayude a la determinación
concreta de los daños -por pérdida de chance- que nuestra legislación
implícitamente si habría regulado. Como objetivo, se pretendió determinar sí la “pérdida de chance” sería
indemnizable como daño en el Código Civil Peruano, llevando a cabo una
profunda investigación doctrinaria. Logrando corroborar la hipótesis planteada,
debido a que ésta figura cumple con las exigencias de todo daño indemnizable,
de allí para afirmar que sí resultaría indemnizable como un daño en nuestro
Código Civil.
The current work looks over: “Loss of the Chance as Damage in the Peruvian Legislation”, being understood that the loss of change is the absence of a sensible and objective possibility of a beneficial event; however, its recognition at the legislative level in the Peruvian legislation – it would apparently generate doubt about its regulation – since the claims are rejected by the jurisdictional bodies. Hence our outlook by suggesting that the loss of chance would be a compensable damage recognized in the Peruvian Civil Code. The hypothesis allowed an approach to affirm that the loss of chance is compensable as damage in Peruvian Civil Code, and that it would be implicitly regulated in article 1985 of the Civil Code; in this sense, the denial of this concept with the argument of the absence of regulation would be illegal and could even become arbitrary; therefore, their acceptance should be mandatory, not for its estimation per se or automatically, but for a fundability analysis. In this sense, this thesis seeks to be a tool not only for lawyers but for judges, as well to help them determine the specific damages - for loss of chance - that our legislation implicitly would have regulated. As a goal, it was tried to determine whether the “loss of chance“ would be compensable as damage in Peruvian Civil Code, carrying out a deep doctrinal investigation. Achieving corroboration of the hypothesis raised, because this figure (loss of chance) meets the requirements of any compensable damage, from there to assert that it would be compensable as damage in our Civil Code.
