The study included the problems related to the provisions contained in article 565-A of the Code of Civil Procedure and their impact on effective judicial protection; therefore, having analyzed various doctrinal perspectives, it has been obtained as a result that by requiring in said article, as a prerequisite, to be up to date in the payment of alimony to demand its reduction, variation, apportionment or exoneration, the effective judicial protection is affected; being the statement of the problem: In what way, the provisions of article 565-A of the Code of Civil Procedure affect the effective judicial protection to trigger the reduction, variation, apportionment or exoneration of alimony? Following the guidelines approved in the research project, in the execution of the same we have used Methods, Techniques and Instruments as part of the Chapter of Methodology considering the scientific rigor of this Thesis; thus, we can indicate that as a Research Method the Scientific Method was used; As Methods necessary to collect and analyze information, general or logical methods (such as the analytical, deductive and inductive method) and specific or legal methods (such as historical and doctrinal methods) were used. In relation to the Techniques and Instruments applied, we rely on the Interview, Observation and Analysis of documents; in conjunction with the Interview Guide and the Document Analysis Guide, respectively; allowing to process the information that supports the Thesis. After analyzing and discussing the results obtained, it was possible to contrast the proposed hypothesis in the sense that by requiring article 565-A of the Code of Civil Procedure to be up to date in the payment of alimony, it affects the effective jurisdictional protection to trigger its reduction, variation, apportionment or exoneration. After the study, conclusions and a recommendation related to a legislative proposal are presented as a contribution to solve the problem observed by the researcher and that 7 motivated her study, as well as with the opinion of professionals specialized in the Science of Law, the regulation of exceptions to article 565-A of the Civil Procedure Code that regulates the special requirement to demand reduction is proposed, variation, apportionment or exemption from alimony, but without affecting the pensions generated at the presentation of the aforementioned claim; specifically, incorporating the second paragraph of Article 565-A of the Code of Civil Procedure.
