In the present research work, we have sought to problematize one of the grounds for divorce that exist typified in our Peruvian family legal system; specifically the cause of “supervening homosexuality“. In this sense, from the basic notions of divorce, of the divorce systems; and from the various conceptions in favor or against that exist on this subject, it has been possible to understand said legal institution. However, the following thesis has also addressed the issue of homosexuality and any impact that it may have on our national family normative system, especially the approach that this phenomenon has had as a cause of separation of bodies and also of divorce. Hence, strictly speaking, we have also done a work of exegesis regarding the causal already mentioned above; but contrasting it; or, rather, looking at it from the constitutional sieve; Therefore, we have analyzed such grounds from the principle of non-discrimination. In this sense, the present investigation has tried to demonstrate that this causal of which we have been speaking, attacks frontally against that constitutional principle to which we already referred. For this reason, it is that after applying various legal research methods and with the help of the indicated and adequate research techniques and instruments, we have been able to demonstrate the general objective set forth in this thesis.
