Our research work is entitled: “The requirement of the principle of written evidence to accredit the de facto union and probation, in the Peru“, starts from the following question: “The principle of written evidence to accredit de facto unions violate probationary freedom, in the current Peruvian Civil Code?”. We have preliminarily responded to that question with the following hypothesis: “The principle of written evidence to prove de facto unions does violate probationary freedom, in the current Peruvian Civil Code.“ Faced with this problem, we have set ourselves the general objective: “Demonstrate that the principle of written evidence to prove de facto unions in Peru violates probation freedom, in the current Peruvian Civil Code. “Finally, and as a main conclusion, we have pointed out that: “The principle of written proof to accredit de facto unions in Peru supposes a very high requirement, contemplated by our Civil Code; because in this way it would be attacking the people who seek to access the different rights that derive from a recognized de facto union; In the same way, such a requirement turns out to be an attempt against the freedom of evidence and the free evaluation of the evidence by the judge.”
