The present research work, titled ““Constitutional Foundations for Reducing the Age of Criminal Liability in Homicide Offenses in Peru,““ aims to determine the legal and constitutional foundations that would support the regulation of criminal liability from the age of sixteen for the offense of homicide in the Peruvian Penal Code. Regarding the objectives, the following were proposed: (i) to analyze the criminal offense of homicide in the national legislation, taking into consideration the statement of reasons regarding its social significance, (ii) to establish the primary duties of the State from a constitutional perspective, considering the integral development of society as a foundation, (iii) to explain the authority granted by the Constitution to the legislator to enact special laws as necessitated by the circumstances. Subsequently, the hypothesis was formulated as follows: ““The legal and constitutional foundations that would support the regulation of criminal liability from the age of sixteen for the offense of homicide in the Peruvian Penal Code include the State's constitutional duty to protect its citizens and the authority granted by the Constitution to the legislator to enact special laws based on the exigencies of the situation.““ viii Finally, legal research methods were employed to address the topic and test the hypothesis. The results were presented conclusively and summarized in the conclusions. This work was conducted as a descriptive-dogmatic research, without the need for a specific population or sample
