Nowadays, Peru lacks a public policy on promoting B2C (business-to-consumer) e-commerce, which is reflected in the incipient level of online sales in comparison with the others countries in Latin American, for example, Brasil, Argentina, Chile or Colombia. The objective of this paper is to identify an oportunity to improve the legislation in Peru, specifically in consumer protection laws, through a normative mechanism that consist of providing basic information to consumers regarding essential points of the virtual purchase, in order to: (i) generate confidence in the consumers respect to online transactions, and (ii) consolidate the development of e-commerce in the country. In addition, we have made one no-probabilistic survey to internet users and interviewed to the specialists in this topic, in order to determine the main causes that prevent the consolidation of B2C e-commerce in our country and to evaluate the impact that implementing the duty of provide basic information would generate in consumers. Likewise, this work was based on a study of international treaties, comparative legislation, specialized doctrine and other countries’ experiences about B2C e-commerce. Finally, although this work focuses on the importance of providing basic information in e-commerce, it also recognizes the importance of other complementary mechanisms that would help to generate trust in the Peruvian consumers such as Self regulation and Educational campaigns.
